Strategies and Activities
Western Kenya Environmental Law Centre will work closely with the members of the private bar in the region, both as individuals and within the framework of the Law Society of Kenya, the Rift Valley Law Society and the Western Kenya Law Society. It shall also collaborate with the Faculty of Environmental Resources Development at Egerton University , the School of Environmental Studies and the Faculty of Law at Moi University , and other relevant academic and training institutions in the region. The faculty at these institutions shall be engaged as researchers, consultants and trainers where appropriate, while students will be encouraged to undertake internships at the Centre and be otherwise involved in its processes. The idea is to harness the expertise that is available in the region in the service of the local communities to help address their environmental problems.
Research is key to the generation of data and options that will inform specific interventions. Research shall also be undertaken to better understand processes of compliance and enforcement and their challenges and opportunities, to document case studies for both good and bad practice, and to generate policy options for improved environmental management.
Training shall be aimed at equipping citizens and citizen groups as well as local level institutions of environmental governance with the awareness and understanding necessary for their effective discharge of their duties in the promotion and protection of environmental rights. The Centre shall develop a curriculum and training materials on EMCA and other sectoral laws and policies, and shall provide training to Provincial and District Environmental Committees, enforcement and regulatory agencies, individuals and community groups on these policies and laws.
Advocacy shall be aimed at mobilising citizens to make demands on institutions of environmental governance, to monitor their performance and to engage with them positively to ensure that they deliver on their legal mandates. For this purpose, the Centre shall design and publish advocacy materials and policy briefs and organise and host forums to promote informed debate. It shall also publish a regular newsletter, Mazingira Magharibi as a vehicle for dissemination, sharing and networking.
Public Interest Litigation shall be used as the ultimate tool in the legal protection of environmental rights. The Centre shall, in collaboration with the members of the Bar in the three provinces, file and prosecute public interest cases on environmental problems, with a view to enforcement of EMCA and engaging legal institutions and processes in the promotion of environmental justice. In addition to filing cases in the High Court as provided by EMCA, the Centre shall file and prosecute complaints in the Public Complaints Committee and other tribunals and forums.
Networking is critical to addressing environmental challenges, particularly because environmental problems, their causes and impacts often transcend administrative boundaries. The Centre shall therefore network with similar organisations in other parts of Kenya , in neighbouring countries and beyond, to share experiences and to work on common problems and challenges. It shall participate in and organise meetings and forums to facilitate such networking. In addition, the Centre shall seek to be part of national, regional and global environmental networks such as the East African Environmental Network, Environmental Law Alliance Worldwide (E-LAW) and the International Network on Environmental Compliance and Enforcement (INECE). In this connection, the Centre will take advantage of networks that RECONCILE is already associated with.
